These terms set out the conditions for using this website and engaging Cahaya's legal services. Please read them carefully before submitting an enquiry or entering a service arrangement with us.

1. Definitions

For the purposes of these Terms and Conditions, the following definitions apply:

  • "Cahaya", "we", "us", or "our" — the legal services practice operating as Cahaya, registered in Malaysia.
  • "Service" — any legal service or advice offered through our website or directly by our practice, including Estate Planning Sessions, Probate and Administration Support, and Complete Guiding Legacy Engagement.
  • "User" or "you" — any individual accessing our website or engaging our services.
  • "Website" — the site accessible at cahaya.world and any related pages.
  • "Agreement" — these Terms and Conditions, together with any service engagement letter or retainer agreement.
  • "Content" — all text, images, documents, and materials published on our website.

2. Acceptance of Terms

By accessing this website or submitting an enquiry, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, please do not use this website or submit enquiries through it.

You must be at least 18 years of age and have the legal capacity to enter into a binding agreement under Malaysian law. Use of this website by persons under 18 is not permitted.


3. Service Description

Cahaya offers inheritance law services in Malaysia, including estate planning guidance, probate and administration support, and comprehensive legacy engagement. Services are provided by qualified legal practitioners in George Town, Penang.

The information on this website is for general informational purposes and does not constitute legal advice. A formal solicitor-client relationship is established only upon execution of a written engagement or retainer agreement.

Our services are available to residents and nationals of Malaysia. We may at our discretion assist persons outside Malaysia in matters governed by Malaysian law, subject to applicable professional regulations.


4. User Responsibilities

When using this website or engaging our services, you agree to:

  • Provide accurate and complete information when submitting enquiries or engaging our services
  • Use this website and its content only for lawful purposes
  • Refrain from attempting to gain unauthorised access to any part of this website
  • Not reproduce, distribute, or commercially use any content from this website without our express written consent
  • Notify us promptly of any changes to information you have provided that may affect your matter

We reserve the right to decline enquiries or terminate engagement where information provided is found to be materially inaccurate or misleading.


5. Intellectual Property

All content on this website — including text, design, structure, and graphics — is the property of Cahaya or its licensors and is protected under Malaysian copyright law.

You are granted a limited, non-exclusive, non-transferable licence to access and read website content for personal, non-commercial purposes. This licence does not permit you to copy, modify, distribute, or use content commercially.

Written documents, advice, and records prepared for you as part of an engaged service remain subject to applicable professional and copyright rules. Use of such documents for purposes outside the scope agreed at engagement requires our written approval.


6. Payment Terms

Our services are priced as follows, payable in Malaysian Ringgit (MYR):

Service Fee (MYR)
Estate Planning Session RM 580
Probate and Administration Support RM 1,250
Complete Guiding Legacy Engagement RM 1,920

Fees are due as agreed in the relevant engagement letter. Additional costs arising from third-party disbursements (court fees, authority filing costs, etc.) will be communicated separately and are not included in the stated service fees.

Accepted payment methods will be confirmed at the time of engagement. Where a service is not commenced due to mutual agreement or client withdrawal prior to work commencing, any deposits paid may be subject to an administrative processing fee. Fees for work already completed are not refundable.


7. Service-Specific Terms

The following terms apply to our legal services:

  • The scope of each service will be confirmed in writing at the time of engagement. Work outside the agreed scope may require a revised arrangement.
  • Timeline estimates are provided as a good-faith guide only. Timelines may be affected by third-party authorities, court scheduling, or the availability of required documentation.
  • We maintain strict confidentiality over all client information and matters, consistent with professional obligations under the Legal Profession Act 1976.
  • Where matters involve Muslim personal law (faraid), applicable Syariah principles will guide the scope of advice. We will communicate clearly where matters fall outside our scope and may refer you to an appropriate specialist.
  • Client cooperation — including timely provision of required documents and information — is essential to progress. Delays caused by client-side factors do not affect fee obligations for work already completed.

8. Disclaimers

Information provided on this website is of a general nature only and does not constitute legal advice. Each person's circumstances are different, and we encourage you to seek a formal consultation before relying on any information presented here.

This website and its content are provided on an "as available" basis. We do not warrant that the website will be free of errors, uninterrupted, or fully up to date at all times.

Outcomes of legal matters depend on many factors outside our control. We do not make representations about specific outcomes, and past results described in general terms should not be taken as an indication of future results in your matter.


9. Limitation of Liability

To the maximum extent permitted by Malaysian law, Cahaya shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of this website or reliance on its general content.

Our liability in connection with any engaged service is limited to the fees paid by you for that specific service. Nothing in these terms limits liability for fraud, death or personal injury caused by negligence, or any other matter where limitation is not permitted by law.

Force majeure: we shall not be liable for delays or non-performance resulting from events beyond our reasonable control, including natural disasters, government actions, or technical failures affecting third-party systems.


10. Termination

Either party may terminate an engagement by giving reasonable written notice. The terms for early termination will be set out in the engagement letter. Work completed prior to notice of termination remains billable.

We reserve the right to decline or discontinue services where there is a conflict of interest, professional obligation, or where we reasonably believe the engagement cannot proceed ethically or lawfully. Provisions relating to confidentiality, intellectual property, and payment survive termination of any engagement.


11. Dispute Resolution

These Terms and Conditions are governed by the laws of Malaysia. Any dispute arising from them shall be subject to the exclusive jurisdiction of the courts of Malaysia.

We encourage parties to resolve disagreements through open, direct communication in the first instance. If a dispute cannot be resolved informally within 30 days, either party may refer the matter to mediation before the Malaysian Mediation Centre, before pursuing court proceedings.

Complaints about professional conduct may be referred to the Bar Council Malaysia in accordance with the Legal Profession Act 1976.


12. General Provisions

  • Entire Agreement: These terms, together with any engagement letter, constitute the full agreement between the parties regarding website use and service engagement.
  • Severability: If any provision of these terms is found unenforceable, it shall be modified to the minimum extent necessary, and the remaining provisions shall continue in effect.
  • Waiver: Failure to enforce any provision shall not constitute a waiver of that provision or any other.
  • Assignment: You may not assign your rights under any engagement without our prior written consent.
  • Notices: Formal notices should be sent to us in writing at the address below or by email to [email protected].

13. Changes to Terms

We may update these Terms and Conditions from time to time. Changes will be reflected in the "Last updated" date at the top of this page. Where changes are material, we will take reasonable steps to notify you.

Continued use of this website after changes are published constitutes acceptance of the revised terms. If you disagree with any changes, you should discontinue use of the website.
